Also we need to emphasize & communicate is the "increased fees" (almost doubled in many cases) for all USCIS services effective end of this month (July 30).
The rallys and campaigns should emphasize this important detail too. This is huge money and not fair to the amount of service that is being currently provided.

we are july first week filers! I haven't opened up an SR yet .. intend to do that soon right after the holidays!
We have received everything else though - EAD/AP/RECEIPT etc. for both me and my wife (same's the case with my colleagues)

So is it a problem if you try to go for landing AFTER you apply for AOS?
What about those who landed before they filed i-485?
I google'ed and came across not-so-good information about this.

Hi, all:
I have a few questions regarding changing job, if anyone knows it , please reply to me. My current situation is:
(1). I-485 was sumitted on 07/2007 and it is still pending. EB3 category.
(2). EAD card valid until 10/2012.
(3). H1-B visa valid until 03/2012 through my current employer.
I find another job which similar to what I-140 describes. But this new employer is a job agency and unwilling to tranfer my H1-B visa. It wants me to work on my EAD card on 1099 form.
So, my questions are:
(1). Will it be problem if I work as independent contractor on 1099 form not W2 form?
i think you can do this on EAD but confirm with and immigration attorney
(2). Is there any problem to new my EAD card since I lost my H1-B visa?
you can work on EAD without H1B but you will be carrying more risk
(3). Do I need to inform INS about this job changing? If so, what docuements I need to submit?
Yes you should file AC 21 related forms and supporting documents. your new job should be in "same or similar" category as you GC job as defined by dept. of labor job codes and descriptions.
BTW its not INS anymore its USCIS
(4). What if my current employer revoke my I - 140, does that mean my GC will be denied? what should I do if I want to keep legal?
Make sure you obtain a copy of your approved I-140. If your current employer revokes it, USCIS might send you a RFE or NOID and you will need to respond with letter of employment from the new employer and submit supporting documentation that your I-140 was already approved and that your new job is similar to the old one.

I can tell you there are roughly 100,000 labor applications filed (50,000 EB3) between Aug 2003 and Dec 2003 for EB India category. The reason was everybody wanted to clear thru regular process before PERM takes over. Those Labors filed after Aug 2003 and before PERM started are moved into backlog and are fully cleary last 4 th quarter. And so 90% of those EB3s may be still there (45,000) hanging. EB2s could have been cleared substantially till Dec 2003. It is all my guess work and not sceintific or factual. also ..this looks very inaccurate ..because I know lot of indians who got H1 during the peak (when h1 was 195k) have gone back. i.e either they got better oppurtunities back home or just went back as they were not getting jobs. I did stay in one of the guest house which had lots of consultants ..none of them are here anymore !!

issue of Immigration in the news lately, the United States Citizenship
and Immigration Services (USCIS) along with the Department of
State(DoS) announced an update to the July Visa bulletin essentially
eliminating any chances to apply for "Adjustment of Status" aka. the
last stage of the Green Card/Permanent Residency process. This
bulletin was was originally published during the mid month of June
inviting all legal immigrants to apply for Permanent Residency.
The Visa bulletin is a formal communication method to all Immigration
adjudication officers and personnel in National and International
consular offices of the United States of America, advising the
personnel of the availability of Permanent Resident visas which are
capped at 140,000 a year worldwide. The system has already forced many
delays and approx. 400,000 applications are back-logged.
This update was released on July 2nd, the first business day for the
month of July. Thousands of dollars were spent in legal fees and
medical examination fees by some 200,000 highly skilled legal
immigrants who chose to follow the rules and abide by the laws.
Several lawsuits have been filed against USCIS and DoS asking for
reimbursement of legal and medical expenses by AILF (American
Immigration Law Foundation) and AILA (American Immigrant Lawyers
Association).
The Legal immigrant community backed by ImmigrationVoice.org (a 15,000

This is exactly what I was saying. People are getting overzealous and are losing their balance. By attracting too much attention when everyone in power is being anti-immigrant you people will hurt everyone. They will impose some more restrictions on us.
We need to lay low for a while until economy improves and focus on keeping our jobs. That is the need of the hour rather than becoming a hero and trying to go against the wave.
One thing that everyne needs to understand is that before the lawmakers, etc., take a stand they study the issue.
Part of the study would be: Why is there so many Indians in the que?
What type of companies are sponsoring most greencards?
Rate of H-1b denials?
Rate of consulate denials?
How are people getting here?
What is the average wage of people being sponsored here?
if people are so skilled then why don't they go into extraordinary ability?
DOL investigations?
The list goes on and on of what the counter attacks are...
People can send out press releases, contact the senators, etc., but it is one way communication. Then other side waits and releases their information. Right now; other side is winning by large margin.
What is going on now with H-1b is direct result of quota completing so fast and it being studied with filed visits, audits. Conclusion was high rate of fraud; let's crack down.

I am curious to know what's stopping the EB3s to port their dates to the EB2 category. I've been seriously considering this lately.
I tried doing that. Convinced the employer to file a new labor for a new position, advertized again, filed a new labor under PERM, applied for a new I-140 and waited for a year for approval ... now the I-140 has been denied for A2P and is under appeal; I must confess that I have lost hope that it'll get re-opened and approved.
So all my efforts for getting a EB2 140 have failed.....what do you recommend, I start this entire process again. Even if I'm willing to bear the cost, the employer will not file yet another labor.
EB3 wait is my only way out now......

Think of it this way..We are foreigners 12K miles from Home...We are here and trying to change the laws of this country...They are listening to us a bit...That in itself is a big achivement.....It is not gonna happen overnight...It is gonna be a long haul and more...Even after the law changes we would need to look out for actual implementation..So you better harden yourself for a long protracted fight...No one promised that this is gonna be easy...You and I have invested so much time ...you and I have no option but to fight it out...

May be just may be because TSC approved a lot of cases for the current PD 2 years ago and have less cases than NSC.

no it will not be voilation of the law at all. consider this scenario thats been going on for the last 30+ years. For example July 2006 visa bulletin for EB2 india was jan 2003 and the August 2006 visa bulletin for EB2 india was unavailable. EB2 india visa numbers might have already been used up when the August 2006 visa bulletin was released but they still accepted the AOS petitions filed until the end of July 2006, they did not issue an updated visa bulletin or a revised visa bulletin saying eb2 india numbers are used up and they will not accept eb2 india aos applications, they continued accpeting AOS applications until the end of july 2006.
If you have the patience you can go through the visa bulletin archieves and find many such examples. The point is for the last 30+ years USCIS\DOS accepted applications according to the visa bulletin even when visa numbers were used up, they could have just followed the same precedent that they themselves set for the last 30+ years and accepted the applications this time as well without issuing a revised visa bulletin. I am no legal expert but that is how i see it.

But the deluge of applications sure did bothered USCIS and hence they worked over time to exhaust numbers. As we all know, there is no rule to say that if there are 20K visa numbers, stop accepting applications once you reach 20K, they have to honor the VB for that month even though they get 200k applications. Thats why they exhausted the number by July 1st and when they could not complete by Jun 30th. I feel that USCIS will have a tough time answering

b) How USCIS approved some folks on July 1st , when the July VB is already effective?
c) lastly the poor communication between agencies and the grievances suffered by every one involved, if at all.

It seems like the deeper we are in the process of GC the more time we spend tracking and speculating on the next week or the week after.
This week is going to be critical for the Notices because if we don't get them by 8/17 the following weeks are going to be even worse.
I'm tempted to call because of the time that has passed and becasue my checks also are dated 6/15.
